In this case the defendant presented Wallops for promotional competition at a face value of $240. The plaintiff ordered 5000 Wallops on phone at a negotiated price of $230 each. Later, he ran into financial constraint forcing him to ask for six months to pay and the defendant agreed.

However, the defendant’s solicitor served Paul with a written notice after two months asking for prompt payment in full.  It is worth noting that the entry form at the shop where the Wallops were displayed at $240 stated in part that the contract is not legally enforceable but will be binding in honour only.
